Gardeners Wimbledon Service Terms and Conditions
These Terms and Conditions set out the basis on which Gardeners Wimbledon provides gardening and related services to residential and commercial clients. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Client means the person, company or organisation booking or receiving services from Gardeners Wimbledon.
Services means any gardening, grounds maintenance, clearance, planting, lawn care, hedge trimming, pruning, soft landscaping, garden tidy-up, or related services provided by Gardeners Wimbledon.
Visit means an individual attendance at the property by our gardeners or contractors to carry out the Services.
Property means the garden, grounds or outdoor area at which the Services are to be performed.
2. Scope of Services
Gardeners Wimbledon provides general gardening and grounds maintenance services within its operational area. The exact scope of the Services for each booking will be agreed in advance with the Client, either on a one-off or recurring basis.
Descriptions of Services provided in quotations, messages or verbal discussions are indicative only and may be adjusted once our gardeners have inspected the Property. Any material changes to scope, price, or timing will be discussed with the Client and will require the Client's consent before proceeding.
We reserve the right to refuse or discontinue Services where it would be unsafe, unlawful, or beyond our reasonable capability, including but not limited to work at excessive height, work involving uncontrolled hazards, or work requiring specialist equipment or licences that we do not possess.
3. Booking Process
3.1 Initial enquiry
Clients may request a quotation or make a booking enquiry by contacting Gardeners Wimbledon through its accepted communication channels. When making an enquiry, the Client should provide accurate information about the Property, access considerations, and the Services required.
3.2 Quotations
Where applicable, we will provide an estimate or quotation based on the information supplied and, where necessary, a site visit. Quotations are normally given either as a fixed price for a defined scope of work or as an hourly rate for time-based Services.
Unless stated otherwise, quotations are valid for 30 days from the date of issue. Quotations may be withdrawn or amended if the information provided by the Client is inaccurate or incomplete, or if conditions at the Property materially change before the work is carried out.
3.3 Confirming a booking
A booking is confirmed once the Client has accepted our quotation or agreed to proceed at our standard rates, and we have confirmed the date or schedule of the Visit. Confirmation may be given verbally or in writing, depending on the nature of the booking.
For certain Services or larger projects, we may require a deposit or written acceptance before confirming the booking. We reserve the right to decline any booking at our discretion.
4. Access and Client Responsibilities
The Client is responsible for providing safe and reasonable access to the Property at the agreed time of each Visit. This includes ensuring gates are unlocked, entry instructions are accurate, and any relevant security arrangements are communicated in advance.
If pets are present, the Client is responsible for keeping them under control and ensuring they do not interfere with the work or pose a safety risk. The Client should also remove or clearly highlight any hazards such as sharp objects, exposed cables or dangerous surfaces.
If our gardeners are unable to gain access to the Property or cannot safely carry out the Services due to circumstances within the Client's control, we may treat this as a late cancellation and charge a fee in accordance with the cancellation terms below.
5. Service Standards and Materials
Gardeners Wimbledon will carry out the Services with reasonable care and skill, using competent personnel and appropriate tools for the tasks being performed. While we aim to achieve the results discussed with the Client, gardening outcomes can vary with weather, soil conditions, plant health and other factors beyond our control.
Unless agreed otherwise, we will provide our own tools and standard equipment. Consumable materials such as compost, turf, plants, fertilisers, seeds and other items may be supplied by us and charged to the Client at the agreed rate, or provided by the Client if this has been arranged in advance.
Where the Client supplies plants or materials, the Client is solely responsible for their suitability and quality. We accept no liability for defects, failures or issues arising from Client-supplied items.
6. Pricing and Payments
6.1 Pricing
Prices for our Services are normally provided as either:
Hourly or time-based rates, with a minimum charge per Visit; or
Fixed prices for specified tasks or projects.
All prices will be communicated to the Client before work is carried out, except where ongoing maintenance has been agreed at standard rates. Where work extends beyond the anticipated time due to factors outside our control, such as unforeseen site conditions or additional tasks requested by the Client, we may adjust the final price accordingly. Any substantial changes in cost will be discussed with the Client as soon as reasonably practicable.
6.2 Payment terms
Unless otherwise agreed in writing, payment is due upon completion of the Services for each Visit or project. For longer-term contracts or regular maintenance schedules, we may invoice periodically in arrears or in advance, depending on the arrangement.
Payment methods will be as instructed by Gardeners Wimbledon from time to time. The Client must ensure that payment reaches us within the stated timeframe on the invoice or as otherwise agreed. If payment is not received on time, we reserve the right to suspend further Services until all outstanding sums have been settled.
6.3 Late payment
We may charge interest on overdue amounts at the maximum rate permitted by applicable law, accruing daily from the due date until payment is received in full. The Client will also be responsible for any reasonable costs we incur in recovering unpaid sums, including debt collection or legal fees, where applicable.
7. Cancellations and Rescheduling
7.1 Client cancellations
If the Client needs to cancel or reschedule a Visit, they must give as much notice as possible. Unless otherwise stated, the following will normally apply:
Cancellations or rescheduling with more than 24 hours' notice before the scheduled Visit will not usually incur a charge, except where we have incurred non-refundable costs specifically for that Visit.
Cancellations or rescheduling with less than 24 hours' notice may be subject to a cancellation fee, which may be up to the full estimated cost of the Visit, at our discretion.
Repeated cancellations or last-minute changes by the Client may result in termination of ongoing maintenance arrangements.
7.2 Our right to cancel
We reserve the right to cancel or reschedule a Visit due to reasons including but not limited to adverse weather, illness, equipment failure, access problems, safety concerns, or other events beyond our reasonable control. We will notify the Client as soon as practicable and will aim to arrange an alternative date. We will not be liable for any loss resulting from such cancellation or rescheduling, other than refunding any pre-paid amounts for Services not provided.
8. Waste Handling and Environmental Regulations
8.1 Garden waste
During the course of providing Services, we may generate garden waste such as grass cuttings, branches, leaves and other green material. Unless agreed otherwise, small quantities of such waste may be neatly bagged or placed in the Client's own garden waste containers or compost areas on site.
Where larger volumes of waste removal are required, this must be agreed in advance and may be subject to additional charges to cover transport, disposal fees and labour. Pricing for waste removal will depend on volume, type of waste and applicable disposal regulations.
8.2 Compliance with regulations
We will comply with relevant waste and environmental regulations when handling and disposing of garden waste. Hazardous waste, contaminated materials and items such as soils containing invasive plants, building rubble or non-garden refuse may require specialist disposal and may not be included in standard Services. The Client must inform us in advance if such materials are present at the Property.
We reserve the right to decline removal of waste that cannot lawfully or safely be handled under our usual arrangements. Any additional costs associated with legal and safe disposal of unusual or hazardous waste will be payable by the Client.
9. Damage, Liability and Insurance
9.1 Our responsibility
Gardeners Wimbledon will take reasonable care to avoid damage to property, plants, fixtures and fittings while providing the Services. If damage occurs as a direct result of our negligence, we will, at our option, either repair the damage, replace the item or offer reasonable compensation, subject to the limitations set out in these Terms and Conditions.
9.2 Limitations of liability
To the fullest extent permitted by law, we shall not be liable for any indirect, consequential or economic loss, including loss of profit, loss of enjoyment, or loss of anticipated savings, arising out of or in connection with the Services.
Our total aggregate liability for any claims arising from a Visit or series of related Visits shall not exceed the total fees paid or payable by the Client for the Services in question. Nothing in these Terms and Conditions shall exclude or limit liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded.
We are not liable for damage or deterioration caused by weather, pests, plant diseases, soil conditions, existing defects or any factor outside our reasonable control. We do not guarantee the survival or performance of plants, turf or seeds once supplied and installed, as their success depends on ongoing care, watering and environmental conditions.
9.3 Client responsibilities
The Client is responsible for informing us of any known issues at the Property, such as underground utilities, irrigation systems, cables, shallow pipework, or fragile surfaces that might be disturbed by gardening activities. We cannot be held liable for damage to items that were not reasonably apparent or were not disclosed by the Client.
10. Health, Safety and Conduct
We take health and safety seriously and will operate in accordance with applicable regulations and good practice for gardening and outdoor work. Our staff are entitled to a safe working environment and to be treated with respect.
We may immediately suspend or terminate Services where our staff face abusive behaviour, harassment, threats, or unsafe conditions. In such circumstances, the Client may still be liable for all or part of the agreed fees for that Visit.
11. Variations and Additional Work
If the Client requests additional tasks or changes to the agreed scope during a Visit or project, we will use reasonable efforts to accommodate these requests, subject to time, availability and suitability. Additional work may be charged at our standard rates or as otherwise agreed between the parties.
Any variation that has a material impact on cost, duration or timing of the Services should be confirmed and agreed. We are not obliged to undertake work beyond the originally agreed scope, and we may require a revised quotation to be accepted before proceeding with major changes.
12. Termination of Ongoing Arrangements
Either party may terminate an ongoing maintenance schedule or recurring service arrangement by giving reasonable notice, typically at least 14 days, unless a different notice period has been agreed in writing.
We may terminate or suspend Services with immediate effect if the Client fails to pay sums due, repeatedly cancels at short notice, breaches these Terms and Conditions, or behaves in a manner that makes continuation of the Services unreasonable.
Upon termination, the Client will remain liable for all Services already provided and any agreed charges due up to the effective date of termination.
13. Data and Privacy
We may collect and store basic personal information required for managing bookings, providing Services, and issuing invoices. Any such information will be handled in accordance with applicable data protection laws and only used for legitimate business purposes relating to Gardeners Wimbledon.
We will not sell or disclose Client data to third parties except where necessary to deliver the Services, comply with legal obligations, or with the Client's consent.
14. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
15. Changes to These Terms
Gardeners Wimbledon may revise these Terms and Conditions from time to time to reflect changes in law, best practice, or the nature of the Services. The latest version will apply to new bookings and ongoing Services from the date on which it is communicated or made available to the Client.
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
By proceeding with a booking or by allowing us to carry out any Visit at the Property, the Client confirms that they have read, understood and agreed to these Terms and Conditions.
